FBA Seller Pro Privacy Policy
Effective as of January 1, 2016

Thank you for installing FBA Seller Pro.  FBA Seller Pro recognizes that privacy is an important matter and operates its services with your privacy protection in mind.
This Privacy Policy describes policies governing FBA Seller Pro’s use of personally identifiable information about you when you use FBA Seller Pro and its services (collectively, the “App”), as well as some of the measures FBA Seller Pro takes to safeguard use of the App.  You acknowledge and agree that by using the App, you agree to be bound by the terms and conditions of this Privacy Policy.  If you do not so agree, you should not access or use the App.  This Privacy Policy is hereby incorporated into the Terms of Use (the “TOU”) published on the App.  Capitalized terms used in the Privacy Policy and not specifically defined herein will have the meaning ascribed to them in any other policies and guidelines documents posted on the App (including, without limitation, the TOU).

1. Modifications to Privacy Policy.  FBA Seller Pro reserves the right to, in its sole discretion, modify the Privacy Policy.  Such modifications are effective upon posting.  You should, therefore, periodically review the Privacy Policy to ensure you have read the most recent version.  You agree to be bound by any modifications to the Privacy Policy.  In particular, your continued use of the App following the posting of any updates or modifications to the Privacy Policy constitutes your acceptance of such changes.  If you object to any provision of the Privacy Policy or any subsequent modifications to the Privacy Policy, your exclusive recourse is to immediately terminate use of the App.
   
   
2. Modifications to Personally Identifiable Information.  If you need to modify or correct any of your personal information in your account profile (such as an updated address), you may log into your account and make such changes in the manner provided in the screen directions.  If your account is terminated for any reason in accordance with the FBA Seller Pro TOU, then FBA Seller Pro may retain your personal information.
   
   
3. Information Collection and Usage. 
1. For certain other activities on the App, such as creating an account and registering as a participant to post User Content to the App, FBA Seller Pro may ask you to provide certain personally identifiable information, such as your name, your email address, a password, your city and state of residence, your telephone number, and other similar information.  Thus, when you opt to partake in certain activities on the App, you will no longer remain anonymous.
2. FBA Seller Pro may use your personally identifiable information to record and/or store particulars about and support your usage of the App.  For example, and without limitation, FBA Seller Pro may use the information provided by you to register and manage your account and deliver certain services to you, to verify your authority to enter the App and to verify User Content as yours, to process activities on the App, to log information about your usage of the App, to provide notices to you regarding certain services, to process any communications from you to FBA Seller Pro, and to improve the functionality and administration of the App, its features, and content.
3. FBA Seller Pro will not use your personal information to send advertising or like marketing messages to you without your consent.  However, FBA Seller Pro may use your personal information without your further consent for messages related to customer service purposes (e.g., general service announcements), App updates, or other such non-advertising or administrative undertakings.  In addition, FBA Seller Pro will not provide, rent, trade, or sell your personally identifiable information to any third party company or like entity, except as described in the “Information Disclosure” section below.
4.   FBA Seller Pro may use cookies and other like tools to, among other things, enhance your App usage, in that you will not have to re-enter certain information during repeated visits to the App (e.g., a cookie may record your password).  In addition, cookies assist FBA Seller Pro in tracking user preferences and patterns and tailoring your experience on the App to your individual preferences.  A “cookie” is a small data file containing a string of characters that is downloaded onto your computer upon your fist visit to the App that uniquely identifies your browser.  While most browsers are set up to automatically accept cookies, you can reset your browser to refuse cookies.  However, if you reset your browser to refuse cookies, certain services and aspects of the App might not properly operate.  FBA Seller Pro may also use web beacons to record the behavior and collect data about App users.  “Web beacons” are small pieces of code placed on a web page to so record behavior and collect data.
5. FBA Seller Pro may collect and store aggregate data about its user base.  For example, and without limitation, FBA Seller Pro may log the total number of visitors to the App or any part or page thereof, dates and times of accessing of the App, IP addresses of computers, operating system specifics, and browser software types.  FBA Seller Pro may evaluate this data for demographic and statistical purposes (e.g., for determining the number and type of visitors to different areas of the App), for administrative purposes (e.g., for ensuring that the App is functioning properly and for improving the utility of the App), and for purposes of tracking trends and users’ actions.  Such aggregate data will be amassed, utilized and divulged in the aggregate only.  Your personal information will not be identified in such aggregate data.
   
   
4. Security Measures.
1. FBA Seller Pro utilizes certain security measures to aid in the protection of your personally identifiable information from disclosure, loss, unauthorized access, modification, and the like.  Such security measures may involve, without limitation, encryption, password protection, and assorted electronic and managerial methods.  Note, however, that while FBA Seller Pro utilizes all reasonable security efforts and measures, no means of Internet transmission or electronic storage may be perfectly secure.  Therefore, FBA Seller Pro makes no pledge of such perfect security with respect to your information. 


5. Information Disclosure.
1. FBA Seller Pro may disclose your personally identifiable information if required to do so by law, in order to cooperate with a subpoena, court order, regulation, or governmental investigation, or in other legally limited situations (e.g., to protect your account from fraud, to investigate violations of FBA Seller Pro’s TOU, to defend against legal claims, or to aid in any similarly protective, investigative, or defensive activity).  However, to the extent legally permissible, we will use reasonable efforts to advise you of the request prior to making the disclosure in order to provide you the opportunity to challenge the propriety of the request.
2. FBA Seller Pro may share your personally identifiable information with third party entities (e.g., vendors) that provide services to FBA Seller Pro.  FBA Seller Pro will endeavor to ensure that such entities use such information only to the extent necessary to perform such services.  At times, FBA Seller Pro may direct you to a third party service or vendor in order to process certain activities on the App.  Note that any personally identifiable information that you provide to such service or vendor will be governed by the privacy policy associated with that third party’s webApp.  While the App may direct you to particular third party services (for processing certain activities or otherwise), possibly via links to other webApps, and while FBA Seller Pro strives to link only to webApps that highly value and maintain privacy, FBA Seller Pro is not responsible for the privacy policies enacted by other such webApps, including, without limitation, the security measures employed by them.
3. FBA Seller Pro may share your personally identifiable information with others to resolve technical matters where the information pertains to page views generated by a bot or other such potentially disruptive, invasive mechanisms.
4. In the event of a merger, acquisition, sale or other like corporate restructuring that FBA Seller Pro or its parent, affiliates, subsidiaries, or the like may engage in, FBA Seller Pro (or its parent, affiliates, subsidiaries, or the like) may assign or transfer your personally identifiable information to a successor or other such party, including without limitation, to a buyer of all or substantially all of FBA Seller Pro’s assets.


6. Children’s Policy.  FBA Seller Pro is a business tool for music and entertainment professionals.  The App is not intended for the use of children under the age of 13 and does not aim to attract children under 13 to the App.  FBA Seller Pro does not knowingly collect personal information from children under 13.
